A producer has filed a defamation lawsuit against Amazon Studios, Vice Studios, and director Rebecca Chaiklin, alleging false portrayal in the documentary series 'Hollywood Hustler: Glitz, Glam, Scam' as an accomplice to convicted fraudster Zach Horwitz.
Allegations Against Amazon
Julio Hallivis claims that his reputation has been severely damaged by suggestions in the documentary that he was an informant and complicit in Horwitz's crimes. Horwitz is currently serving a 20-year sentence for a $650 million Ponzi scheme, having deceived around 250 investors with fake contracts from Netflix and HBO.
Hallivis, a former business partner of Horwitz at 1inMM Productions, asserts in the lawsuit that he had no involvement in financing and was unaware of the fraud until Horwitz's arrest. The lawsuit contends that the docuseries, produced by Library Films, Vice Studios, and Article 19 Films for Amazon MGM Studios, wrongly implies Hallivis's involvement in the scheme.
Impact on Hallivis's Reputation
'As a result of defendants’ desire to sensationalize the series and boost viewer numbers, Hallivis’ reputation and career have been destroyed, causing him great personal suffering and loss of earnings,' states the lawsuit. Hallivis did not participate in interviews for the documentary, which premiered on October 17 on Prime Video. He is classified as a private figure, which imposes a lower threshold for proving defamation.
The documentary features an interview with civil attorney Alex Loftus stating that Horwitz 'couldn’t do this alone' and suggesting that Horwitz might be protecting someone in his inner circle. The series presents images of Horwitz and Hallivis together, with commentary describing Hallivis as 'intense' and 'on edge.'
Legal and Personal Consequences
The lawsuit argues that scenes implying Hallivis's involvement are defamatory, portraying him as nervous and paranoid due to his alleged complicity. The final episode hints that Hallivis and his brother Diego acted as informants to aid the government's case against Horwitz, implying cooperation was needed to minimize criminal exposure.
Hallivis was interviewed once by the FBI and the Securities and Exchange Commission and was never informed of any suspicions against him. The series includes a quote from Loftus, who represented some investors, stating, 'If Julio was spending all day and all night with Zach Horwitz for months at a time I don’t see how he would possibly not know that this was a fantasy.'
Attorney Representation
Loftus admitted lacking conclusive evidence that Hallivis was a fraudster but claimed there were indications suggesting deceit, a point emphasized in the lawsuit. The complaint mentions that Hallivis has been ostracized by former business partners, including his brother, who reportedly told Hallivis they could not collaborate due to the reputational harm.
Hallivis is represented by attorney Alexander Rufus-Isaacs, known for several defamation cases against Netflix on behalf of clients claiming defamation in various shows.
