Musk's xAI Faces Legal Heat Over Gas Turbines

Elon Musk’s xAI is operating 46 gas turbines at its Mississippi data center, utilizing a regulatory loophole to sidestep air pollution oversight, sparking legal challenges.

Regulatory Loopholes

The turbines, considered 'mobile' by Mississippi as they are on flatbed trailers, bypass air pollution regulations for a year. The Southern Environmental Law Center (SELC), representing the NAACP, argues that federal law still classifies these as stationary, requiring regulation.

NAACP Legal Action

The NAACP, representing local residents, has initiated a lawsuit against xAI, claiming the unchecked emissions exacerbate local air quality issues. This week, they sought an injunction to halt turbine operations.

Permits and Operations

xAI has permits for 15 turbines. The Greater Memphis Chamber of Commerce previously indicated that 'about half' of 35 turbines operational in May 2025 would remain. However, xAI has increased this to 46, as reported by Mississippi Today.

Environmental Concerns

The NAACP's lawsuit highlights the environmental risks posed by the unregulated turbines, stressing the need for adherence to federal air quality standards.
