Disney’s CEO Faces FCC Free Speech Battle

Disney CEO Josh D’Amaro is embroiled in a dispute with the Trump administration over ABC's 'The View', challenging the FCC's investigation into the show for alleged equal time rule violations.

Disney's Legal Challenge

A week after outlining plans to enhance Disney Plus, newly appointed CEO Josh D’Amaro is now focusing on a legal battle. Disney-owned ABC has accused the Trump administration of infringing on its First Amendment rights due to an FCC investigation into 'The View'.

The FCC is scrutinizing whether 'The View' violated the equal time rule after featuring Democratic candidates James Talarico and Jasmine Crockett without Republican counterparts. ABC asserts that 'The View' has been exempt from this rule for over two decades as it qualifies as a “bona fide news interview program.”

The FCC's Stance

ABC's filing claims the FCC's actions threaten to suppress free speech, stating, “The danger is that the government will simply decide which perspectives to regulate and which to leave undisturbed.”

Trump-appointed FCC Chairman Brendan Carr has previously threatened to revoke broadcast licenses over content aired on Disney’s networks, including segments from 'Jimmy Kimmel Live!'.

Trump's Influence on Media

The Trump administration’s influence extends beyond Disney. Paramount, seeking to curry favor, canceled 'The Late Show with Stephen Colbert' amid an $8 billion merger with Skydance, a decision perceived as politically motivated.

Despite Disney’s past attempts to appease the Trump administration, such as a $15 million settlement over a defamation suit in 2024, tensions remain high. The FCC's recent directive for Disney-owned ABC stations to renew licenses by May 28th, years ahead of schedule, highlights ongoing pressures.

Disney's Stand

In a letter to D’Amaro, FCC Democratic commissioner Anna M. Gomez criticized Disney's past concessions to the Trump administration. Gomez emphasized that the First Amendment is not for the government to grant or withhold, urging Disney to defend its rights.

As D’Amaro navigates this challenging legal landscape, the battle with the Trump administration could define his tenure. The situation underscores the urgency for Disney to assert its position on free speech, potentially leading to a high-stakes legal confrontation.

ABC’s strong stance against the FCC reflects a shift in Disney’s approach, moving away from defensive tactics towards actively challenging perceived threats to its media practices and free speech rights.
